Terms of Service

These Terms of Service (the "Terms") govern the use of the komshia.com platform (the "Platform") operated by Komshia (Burgas, Bulgaria). By registering on or using the Platform you are deemed to have accepted these Terms.
1. Parties and Definitions
- "Platform": the online marketplace offered under the komshia.com domain.
- "Operator": Komshia, Burgas, Bulgaria.
- "Seller": a merchant or business established in Türkiye or Bulgaria that lists products on the Platform.
- "Buyer": a natural or legal person placing orders through the Platform.
- "Escrow": the custody mechanism under which payment is held in a secure account until delivery is confirmed by the Buyer.
2. Nature of the Platform: Intermediary Model
The Platform is an intermediary service provider connecting buyers and sellers. The sales contract is concluded directly between the Buyer and the Seller; the Operator is not the owner, seller or manufacturer of the listed products.
The Operator intermediates the Seller’s representations regarding the legality, characteristics, content and delivery of products, and is subject to the intermediary liability regime under Turkish Law No. 6563 on Electronic Commerce and the EU Digital Services Act.
3. Membership and Account Security
- Membership requires being at least 18 years old and providing accurate, up-to-date information.
- You are responsible for the confidentiality of your credentials and for all transactions made through your account.
- In case of suspicious activity the Operator may temporarily suspend the account.
4. Seller Conditions
- Sellers submit information evidencing that they are businesses registered in Türkiye or Bulgaria at the time of application.
- Applications undergo automated pre-checks; the Operator reserves the right to audit afterwards and to close non-compliant accounts.
- The Seller is solely responsible for the legality, authenticity and conformity of listed products, for issuing invoices and for its tax obligations.
- The Seller must dispatch orders within a reasonable time and enter tracking details on the Platform.
5. Escrow Flow
The Buyer’s payment is blocked in the escrow account at the moment of ordering. The Seller ships the product; once the Buyer confirms delivery on the Platform, or the confirmation period expires without a dispute, the payment is transferred to the Seller after deduction of the commission.
If the Buyer raises a dispute within the period, the payment remains in escrow until the dispute is resolved. In dispute resolution the Operator evaluates the evidence submitted by the parties and decides on refund or release.
6. Commission and Fees
The Operator charges a commission of 5% (five percent) on each completed sale. The commission is deducted automatically when funds are released from escrow to the Seller. Registration and listing are free of charge; fee changes are announced at least 30 days in advance.
7. Prices and Currency
Product prices are held on the Platform in euro (EUR) and displayed to users in TRY, BGN or EUR depending on language preference. TRY equivalents are calculated at the current exchange rate; the rate at the time of collection applies. Payments are made via Stripe (EUR) or iyzico (TRY).
8. Prohibited Products and Conduct
- Listing illegal, counterfeit, stolen or dangerous products is prohibited.
- Circumventing escrow and commission by directing transactions off-Platform is prohibited.
- Misleading product descriptions, fake reviews and manipulative pricing are prohibited.
- Automated access harming the Platform’s infrastructure, reverse engineering and data scraping are prohibited.
9. Intellectual Property
The Platform’s software, design, trademark and content belong to the Operator. Sellers represent that they own the rights to the images and content they upload and grant the Operator a limited licence to publish them on the Platform. Infringement notices should be sent to info@komshia.com.
10. Limitation of Liability
The Operator does not guarantee that the Platform will operate without interruption or error. Subject to mandatory legal provisions, the Operator’s liability is limited to the commission collected on the relevant transaction. Consumers’ statutory rights remain unaffected.
11. Suspension and Termination
Accounts violating these Terms may be warned, suspended or closed. Users may close their account at any time; provisions relating to ongoing orders and escrow processes remain in force until completed.
12. Governing Law and Dispute Resolution
These Terms are governed by Bulgarian law, without prejudice to the mandatory consumer protection provisions of the consumer’s country of residence. Consumers resident in Türkiye may apply to Consumer Arbitration Committees and Consumer Courts; consumers resident in the EU may apply to their local consumer authorities and the EU Online Dispute Resolution (ODR) platform.
