Distance Sales Agreement

This Distance Sales Agreement (the "Agreement") is concluded electronically between the Buyer and the Seller for every order placed on komshia.com, in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, as well as the EU Consumer Rights Directive (2011/83/EU).
1. Parties
- SELLER: the business registered on the Platform whose trade name, address and contact details are stated in the order summary and on the invoice.
- BUYER: the natural or legal person placing the order, whose details appear on the order form.
- INTERMEDIARY SERVICE PROVIDER: Komshia (Burgas, Bulgaria, info@komshia.com) — not a party to the sales contract; provides the payment escrow and platform service.
2. Subject of the Agreement
The subject of the Agreement is the sale and delivery of the product ordered electronically by the Buyer on the Platform, whose characteristics and sales price are stated on the order page, and the determination of the parties’ rights and obligations.
3. Product Details and Price
The essential characteristics of the product, unit price, quantity, total price including taxes, shipping cost and payment method are shown on the order confirmation page and in the electronic confirmation sent after the order. Prices are set in EUR; TRY or BGN displays are calculated at the exchange rate at the time of ordering and fixed in the order confirmation.
4. Payment and Escrow
The Buyer pays the price via Stripe (EUR) or iyzico (TRY). The payment is held in an escrow account until the Buyer confirms delivery; this mechanism does not remove the Buyer’s statutory rights — it provides additional protection.
5. Delivery
The product is shipped by courier to the delivery address provided by the Buyer. The delivery period may not in any case exceed 30 (thirty) days from the order date. If the Seller fails to perform within this period, the Buyer may terminate the Agreement and the price is immediately refunded from escrow.
The shipment tracking number is communicated to the Buyer via the Platform. For packages visibly damaged on delivery, it is recommended to have the courier draw up a damage report.
6. Right of Withdrawal
A Buyer acting as a consumer has the right to withdraw from the Agreement within 14 (fourteen) days of receiving the product, without giving any reason and without penalty. Notice of withdrawal may be given via the order page on the Platform or by an explicit statement to info@komshia.com.
If the right of withdrawal is exercised, the product must be returned to the Seller within 10 (ten) days of the notice; the price is refunded by the original payment method within 14 (fourteen) days of the return reaching the Seller or the Buyer providing proof of dispatch.
7. Exceptions to the Right of Withdrawal
Pursuant to Art. 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for:
- Products personalised or made to order at the Buyer’s request,
- Products liable to deteriorate quickly or whose expiry date may pass,
- Products unsuitable for return for health and hygiene reasons once unsealed,
- Products that, after delivery, are mixed with other goods and cannot by their nature be separated,
- Unsealed audio/video recordings, software and consumables.
8. Defective Goods and Warranty
If the product proves defective, the Buyer may choose between free repair, replacement with a non-defective equivalent, price reduction or rescission of the contract (Law No. 6502, Art. 11). Defect claims are raised through the Platform’s dispute mechanism; as the payment is in escrow, the process is resolved quickly.
9. B2B Orders
Where the Buyer orders as a merchant for professional purposes, the consumer right of withdrawal does not apply; such orders are subject to the Turkish Commercial Code / Bulgarian Commerce Act and the Platform’s dispute process.
10. Protection of Personal Data
Personal data processed in connection with the order is processed in accordance with the Platform’s Privacy Policy and KVKK Notice, and stored encrypted.
11. Dispute Resolution
Consumers resident in Türkiye may apply to the Consumer Arbitration Committees of their place of residence within the monetary limits announced by the Ministry of Trade, or to the Consumer Courts. Consumers resident in Bulgaria may apply to the Commission for Consumer Protection (КЗП) and to the EU Online Dispute Resolution (ODR) platform (ec.europa.eu/consumers/odr).
12. Entry into Force
This Agreement is deemed concluded when the Buyer confirms the order. The Buyer declares having read and accepted the pre-contractual information and this Agreement before ordering. The text of the Agreement is stored with the order record and provided to the Buyer on request.
